The existing EMC Directive (89/336/EC) came into force in 1996, together with UK legislation SI 2372. The requirements for installations were not entirely clear and different interpretations of Regulation 13 of SI 2372 "Excluded Installations" did not help matters for installation owners and operators. An installation was ‘excluded’ from the CE Marking process, but had to demonstrate compliance with the protection requirements of the EMC Directive.
The revised EMC Directive (2004/108/EC) was published in December 2004 and one of the most notable differences from the old version is the more prescriptive requirements for installations. This new EMC Directive is now in force and has a corresponding UK Statutory Instrument (3418:2006) bringing the requirements into UK law. The new Directive is much more explicit regarding the requirements for installations, stating that:
